Terms of Service for Locksmith.contact

These Terms of Service ("Terms") govern your access to and use of the Locksmith.contact website and referral service (the "Service"). By accessing or using the Service, you agree to be bound by these Terms, including the arbitration agreement and class action waiver in Section 10. If you do not agree, do not use the Service.
1. What the Service Is (and Is Not)
Locksmith.contact is a referral and matching service only. We collect your ZIP code and phone number and provide you with contact information for up to three independent locksmith businesses that serve your area. We are not a locksmith, we do not perform, supervise, inspect, or warrant any locksmith work, and we are not a party to any transaction between you and a locksmith. Any listing, "Verified" badge, rating note, or match is informational only and is not an endorsement, recommendation, or guarantee of any provider, price, arrival time, or outcome.
2. Independent Providers
Every locksmith accessible through the Service is an independent business. No agency, employment, partnership, joint venture, or franchise relationship exists between Locksmith.contact and any provider. Providers set their own prices, schedules, and service terms and are solely responsible for their own licensing, insurance, permits, conduct, and workmanship. You are solely responsible for evaluating any provider before hiring them, including confirming credentials, insurance, and the total price before work begins.
3. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that all information you submit is accurate.
4. Consent to Be Contacted
By submitting your phone number through the Service, you expressly consent to receive calls and text messages, including calls and texts placed using automated technology or prerecorded messages, from Locksmith.contact and from up to three independent locksmiths matched to your request, at the number you provided, for the purpose of responding to your request. Consent is not a condition of purchasing any goods or services. Message and data rates may apply. You may revoke consent by replying STOP to a text or by emailing [email protected].
5. Acceptable Use
You agree not to submit false or fraudulent requests, use another person's phone number without authorization, scrape or harvest data from the Service, interfere with its operation, or use it for any unlawful purpose. We may block, throttle, or refuse service to anyone at our sole discretion.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY PROVIDER WILL RESPOND, ARRIVE, PERFORM WORK COMPETENTLY, HONOR ANY QUOTED PRICE, OR MEET YOUR EXPECTATIONS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. INFORMATION ON THIS SITE, INCLUDING BLOG CONTENT, IS PROVIDED FOR GENERAL INFORMATION ONLY AND IS NOT PROFESSIONAL, LEGAL, OR SECURITY ADVICE.
7. Release
Your dealings with any locksmith found through the Service, including payment, performance, quality, timing, pricing disputes, and property damage, are solely between you and that provider. To the fullest extent permitted by law, you release Locksmith.contact and its owners, operators, affiliates, and agents from any and all claims, demands, and damages of every kind, known or unknown, arising out of or connected with such dealings or with the acts or omissions of any independent provider.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LOCKSMITH.CONTACT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR ANY PROVIDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU; IN THAT CASE OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
9. Indemnification
You agree to defend, indemnify, and hold harmless Locksmith.contact and its owners, operators, affiliates, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or connected with your use of the Service, your violation of these Terms, or your dealings with any independent provider.
10. Dispute Resolution: Arbitration and Class Action Waiver
Please read this section carefully. Any dispute, claim, or controversy arising out of or relating to the Service or these Terms that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in Duval County, Florida, or, at your option, by telephone or video conference. Judgment on the award may be entered in any court of competent jurisdiction. Either party may instead bring an individual claim in small claims court. YOU AND LOCKSMITH.CONTACT EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Claims must be brought within one (1) year after the claim arises, to the extent permitted by law.
11. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Subject to Section 10, exclusive venue for any court proceeding lies in the state and federal courts located in Duval County, Florida, and you consent to their jurisdiction.
12. Intellectual Property
The Service, including its content, design, text, and branding, is the exclusive property of Locksmith.contact and its licensors. You may not copy, reproduce, or create derivative works from any part of the Service without our prior written consent.
13. Third-Party Links and Websites
The Service may contain links to third-party websites, including provider websites and social profiles. We have no control over and assume no responsibility for their content, policies, or practices. Accessing them is at your own risk.
14. Termination
We may suspend or terminate access to the Service at any time, with or without notice, for any reason, including breach of these Terms. Sections 6 through 11 survive any termination.
15. Changes to These Terms
We may modify these Terms at any time by posting an updated version on this page with a new effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
16. Severability; Entire Agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be enforced to the maximum extent permissible. These Terms, together with the Privacy Policy, are the entire agreement between you and Locksmith.contact regarding the Service and supersede all prior agreements.
